St. Albans Man Admits Gun Possession While Using Drugs

TheOffice of the United States Attorney for the District of Vermont stated thatMichael N. Cruz, age 23, of St. Albans, pleaded guilty today to possessing asemiautomatic Glock pistol while using drugs. Cruz entered his plea before U.S.District Court Judge J. Garvan Murtha in federal court in Brattleboro.
Accordingto facts presented in the case, Cruz was arrested by the Vermont State Policeon October 17, 2011, after a motorist reported seeing him waving a pistol whiledriving his Audi erratically on Interstate 89. Cruz was under the influence ofcocaine and marijuana when stopped, and had two loaded pistols in the car – theGlock and a Taurus – along with marijuana and over $2,000 in cash. In his pleaagreement, Cruz agreed that his fine would include over $8,500 in cash seizedfrom him in early 2012, when the U.S. Bureau of Alcohol, Tobacco & Firearmsexecuted a federal search warrant at his apartment.
JudgeMurtha scheduled sentencing for May 22, 2013. Cruz is detained in the custodyof the U.S. Marshals Service. The case was investigated by the Vermont StatePolice, and ATF. Cruz is represented by Federal Public Defender MichaelDesautels. The United States is represented by Assistant U.S. Attorney WilliamDarrow.
